UPDATE: District Attorney drops case against Lelan Donelson of Brush

Brush Police Department – The Brush PD recently posted an update on the case involving Lelan Donelson. According to the press release from the City of Brush from January 27, 2025, on January 16, the Brush Police Department was called to a residence where the organization ‘Colorado Ped Patrol’ was making accusations of internet luring of a minor.
Members of that organization agreed to come to the police department to assist in the investigation of the allegations. Colorado Ped Patrol provided documentation indicating the stated offenses. The case was then handed over to the Brush investigators from there.
As of an April 1st posting from the Brush Police Department, an arrest warrant was issued for Lelan Donelson of Brush. As stated in the posting, stemming from the original report, evidence for 140 counts of sexual exploitation of a child were found. He is currently booked into Morgan County Detention Center, where he is being held without bond until advised by a judge. The information presented by the Colorado Ped Patrol has been turned over to the 13th Judicial District DA's for a filing decision.
In a posting from the Brush PD on Thursday, October 30th, there was an update in this case, as the District Attorney's office has decided to dismiss the case against Lelan Donelson.
The posting went onto state: This decision highlights the different, but essential, standards at each stage of the justice system. Police officers are required to have probable cause to make an arrest. The District Attorney's office must then determine if they can prove the entire case beyond a reasonable doubt at trial, which is a much higher legal standard. The officer & investigator dedicated a great deal of time to the investigation, and they respect the DA’s decision in this matter.
The posting also stated that as a police department, we are one part of a larger criminal justice system, and we respect the vital role of our partners in the District Attorney's office and the courts. Each has a duty to provide necessary checks and balances.
